Smoke screen: why the presidential bill does not meet the milestones set by the European Commission

Synthesis: 

  • The presidential amendment to the Supreme Court Act moves Poland away, not closer to the implementation of the milestones agreed with the European Commission

  • As a result of the changes, the Disciplinary Chamber will be transformed rather than abolished

  • The Act recognizes that persons sitting in the Disciplinary Chamber have the judge status
     
  • Under the amendment, cases of judges may still be heard by persons previously sitting in the Disciplinary Chamber
     
  • The Act does not include the necessary changes to the National Council of the Judiciary which would make it independent of politicians
